Returns Policy and Terms of Use

Returns: Prior authorization is required for returns. Any return must be unused, unwashed, undecorated, unaltered, and free of stains, makeup, deodorant, or any visible signs of wear. Any claims regarding merchandise must be made within 7 days of receipt. It is understood that when payment is not made according to the agreed terms, all orders will be held from manufacturing and shipping. If legal action, including attorneys, is required to collect invoices, the customer will be responsible for collection costs, including fees on all overdue amounts. I, the undersigned, acknowledge the terms of sale and authorize my creditors and my bank to release information about my account(s) to JYA Fashions.

JYA Fashions and its parent companies, subsidiaries, and affiliates (collectively referred to as "the Company") provide the Company’s website, www.jyafashions.com (the "Site"), to its customers as a service subject to the following terms. By using the Site, you agree to be legally bound by the following basic rules, terms, and conditions (the "Agreement") governing your use of the Site and the purchase of products from the Company through the Site. Unless otherwise specified, this Site and its Content are displayed solely for the purpose of promoting the Company’s products and services available in the United States. The prices displayed on the Site are in U.S. dollars and are valid and effective only in the U.S. All information you provide in connection with a purchase transaction or other monetary transaction with this Site must be accurate, complete, and current. You will pay all charges incurred in your credit card, debit card, or other payment method used in connection with a purchase or other monetary transaction with JYA Fashions at the prices in effect when such charges are incurred. When you place an order, we will ship it to the address designated by you as long as the shipping address complies with the shipping restrictions set forth on this Site. JYA Fashions may, at its sole discretion, limit or cancel quantities purchased per person, per household, or per order. We may also reserve the right to refuse any order placed for any reason or no reason. JYA Fashions further reserves the right not to sell to dealers, resellers, or distributors through the Site. In the event we make a change to an order, we will attempt to notify you using the contact information provided by you at the time of the order.

Colors

JYA Fashions takes care to display as accurately as possible the colors of our products that appear on the Site. However, because the actual colors you see depend on your monitor display settings, we cannot guarantee that your monitor's display of any color will be accurate.

User Comments, Feedback, and Other Submissions

Other than personally identifiable information necessary to place an order, any material, information, feedback, comments, or other submissions disclosed or transmitted to JYA Fashions on or by this Site ("User Comments") is and will be considered non-confidential and non-proprietary. Indemnification

You agree to defend, indemnify and hold harmless JYA Fashions, its parents, subsidiaries, affiliates, successors, and assigns and their respective directors, officers, employees, agents, co-branders, or other partners, from and against any and all claims, damages, costs, and expenses, including attorneys fees, arising from or related to your use of the Site, your violation of this Agreement, or your violation of any rights of another.

Termination

These terms are effective unless and until terminated by either you or JYA Fashions at any time. If you want to terminate your legal agreement with JYA Fashions, you may do so (a) by notifying us at any time and (b) closing your accounts for all of the services which you use, where JYA Fashions has made this option available to you. Your notice should be sent, in writing, to JYA Fashions' address set forth in this Agreement. JYA Fashions may also terminate this Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, if in JYA Fashions' sole discretion you fail to comply with any term or provision of this Agreement. Upon any termination of the Agreement by either you or JYA Fashions, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the terms of this Agreement or otherwise.

Miscellaneous

This Agreement shall be construed in accordance with the laws of the State of California, without regard to any conflict of law provisions. You agree to hereby submit to the exclusive jurisdiction of any state or federal court sitting in the County of Los Angeles, State of California. You agree that the statute of limitations for any claim against JYA Fashions shall be brought within one year from when the claim arose. If for any reason a court of competent jurisdiction finds any provision or portion of this Agreement to be unenforceable, the remainder of this Agreement will continue in full force and effect.
